thisAgreement.
5.4PursuanttothisAgreement,allrightsvestedinthe Software Productshallremaininthe
ownershipoftheLicensor,exceptforthosetowhichtheUserisentitledunderlaworbyvirtue
ofthisAgreement.
6RightsoftheUser
6.1 The Useris entitled to install the S oftware Product into one hardware device (desktop,
handheld, portable computer, navigation device), and to run and use one copy of the
SoftwareProductorapreinstalledcopyoftheSoftwareProductthereon.
6.2 TheUseris entitledto make onebackup copy ofthe SoftwareProduct. However, if the
SoftwareProductoperatesafterinstallationwithouttheus e of theoriginalmediacopy, then
theoriginalmediacopys hallbedeemedtobeabackupcopy.Inallothercases,theUseris
onlyentitled to use thebackupcopy if the originalmedia copy of theSoftwareProducthas
beenascertainablyandunequivocallyrenderedunsuitableforitslawfulandintendeduse.
7Limitationsofuse
7.1TheUserisnotentitled
7.1.1toduplicatetheSoftwareProduct(tomakeacopythereof);
7.1.2tolease,rentorlenditortotransferittoathirdpersonforanyreason;
7.1.3 to t ranslate the Software Product (including translation (compilation) to other
programminglanguages);
7.1.4todecompiletheSoftwa reProduct;
7.1.5toevadetheprotectionoftheSoftwareProductortomodify,circumventorobviatesuch
protectionthroughtechnologicalorbyanyothermeans;
7.1.6 to modify, extend, transformthe Software Pr oduct (in whole or in part), to separateit
intoparts,combineitwithotherproducts,installitinotherproducts,utiliseitinotherproducts,
notevenforthepurposeofachievinginteroperabilitywithotherdevices;
7.1.7apart from usingthe computerprogram, to obtaininformationfrom theDatabase as a
part of the Software Product, to decompile the Database, to use, copy, modify, extend,
transformtheDatabaseinwholeorinpartorthegroupofdatastoredtherein,ortoinstallitin
other productsorotherwise,utiliseitinotherproductsortotransferit,notevenwiththeaim
ofachievinginteroperabilitywithotherproducts.
7.2TheUsermayonlyusethecontentsavailablethroughtheSoftwareProductandprovided
bythirdpartiesandthedatareceivedthroughtheservicesprovidedbythirdparties(including
but not limited to the trafficdatareceived fromthe RDS TMC traffic informationservice)for
his/herownpersonalbenefitandathis/herownrisk.Itisstrictlyprohibitedtostore,totransfer
ortodistributethesedataorcontentsortodisclosetheminfullorinparttothepublicinany
formatortodownloadthemfromtheproduct.
8Nowarranty,limitationofliability
8.1 The Licensor hereby informs the U ser that although the greatest care was taken in
producing the Software Product, giventhe nature of the SoftwareP roduct and its technical
limitations, the Licensor does not provide a warranty for the S oftware Product being
completely error-free, and t he Licensor is not bound by any contractual obligation whereby
theSoftwareProductobtainedbytheUsershouldbecompletelyerror-free.
8.2 The Licensor does not warrant that the Software Product is suitable for any purpose
definedeitherbytheLicensorortheUser,anddoesnotw arrantthattheSoftwareProductis
capable of interoperating with any other system, device or product (e.g. software or
hardware).
8.3TheLicensordoesnotassumeanyresponsibilityfordamagesincurredduetoanerrorin
theS oftware Product(includingerrorsof the computerprogram, thedocumentationandthe
Database).
8.4 The Licensor does not assume any responsibility for damages incurred due to the
Software Product not being applicable for any defined purpose, or due to the error or
