incompatibilityoftheSoftwareProductwithanyothersystem,deviceorproduct(e.g.software
orhardware).
8.5 The Licensor also draws the attention of the User to the fact that, when using the
SoftwareProductinanyformofvehicle,observingthetrafficregulationsandrules(e.g.useof
obligatoryand/orreasonableandsuitablesecuritymeasures,properandgenerallyexpected
careand attention in the givensituation, and special care andattentionrequired due to the
useoftheSoftwareProduct)istheexclusiveresponsibilityoftheUser.TheLicensorshallnot
assume any responsibility for any damages occurred in relation to use of the Software
Productinamotorvehicle.
8.6By concludingtheAgreement, theUser shall, in particular,acknowledgetheinformation
statedinSection8above.
9Sanctions
9.1 The Licensor hereby informs the User that, if the Licensor finds its rights under the
CopyrightActtobebreached,theLicensormay
9.1.1seekjudicialrecognitionofthisbreach;
9.1.2demandthatthebreachceaseandorderthepersoninbreachtorefrainfromcontinuing
suchactions;
9.1.3 demand that the person under breach give proper compensation (even by way of
publicityattheexpenseofthepersoninbreach);
9.1.4claimthereturnoftheincreaseofassetsduetothebreach;
9.1.5demandtheceaseofthewrongfulactionand,demandrestitutiontoitsstatebeforethe
breach was committed at the ex pense of the person in breach, and may demand the
destructionofinstrumentsandmaterialsusedtocommitthebreachaswellasoftheproducts
createdbythebreach;
9.1.6claimfordamages.
9.2TheLicensorherebyalsoinformstheUserthatthebreachofcopyrightsandrelatedrights
isacrimeunderA ctIVof1978ontheHungarianCriminalCode,whichmaybesentencedof
twoyearsinprisoninbasiccasesanduptoeightyearsinprisoninaggravatedcases.
9.3Contentsandservicesprovidedbythirdparties
TheLicensorherebyexcludesanyliabilityofitsownfortheDatabaseintheSoftwareProduct
andforanycontentorserviceprovidedbyathirdpartybyusingtheDatabase.TheLicensor
doesnot warrant the quality, suitability, accuracy , fitness fora specificpurposeor territorial
coverageoftheproductorserviceortheavailabilityoftheservice,anditspecificallyexcludes
any liability for the s uspension of the service, and any damage arising in relation to t he
serviceorforcompletecancellationoftheservice.
Therelevantinformationand data inconnectionwith thecontents andservicesprovidedby
third parties are available at www.naviextras.com. The User hereby acknowledges that the
contentsandservicesprovidedbythirdpartiesmayonlybeusedattheriskoftheUserand
forthepersonalbenefitoftheUser.
9.4ContentsandservicesprovidedbytheLicensororanagentoftheLicensor
The Licensor or a contractual partner may offer various products and services to the User
throughwww.naviextras.com.TheUsermayonlyusetheseserviceswhentheUserhasread
andunderstoodthe relevantend user licenseagreement(s) atwww.naviextras.comandthe
Userisobligedtousetheservicesinlinewiththetermsandconditionsthereof.
9.5 The partiesherebyagree that thecourtsof the Republicof Hungarywill haveexclusive
jurisdictiontoruleonanydisputesarisinginconnectionwiththisAgreement.
10.Anonymousdatacollection
10.1 The U ser hereby acknowledges that the Software Product may collect and store data
connectedtotheusageoftheSoftwareProductbytheUser(e.g.movement/routedata,user
interactiondata).SuchdatacollectionfunctionsmaybedisabledorenabledbyUseranytime
from within the corresponding menu. The collected data is connected to the device type
