Kyocera Communications, Inc. (“Kyocera”) End
User License Agreement
CAREFULLY READ THE FOLLOWING TERMS ANDCONDITIONS (“AGREEMENT”)
BEFORE USING OROTHERWISE ACCESSING THE SOFTWARE ORSERVICES
PROVIDED WITH YOUR KYOCERADEVICE. THE SOFTWARE AND SERVICES
PROVIDEDWITH YOUR KYOCERA DEVICE ARE SOLELY FORPERSONAL USE BY
YOU, THE ORIGINAL END USER,AS SET FORTH BELOW.
BY ACTIVATING, USING, DOWNLOADING ORINSTALLING THIS KYOCERA DEVICE
AND/OR THESOFTWARE PROVIDED WITH IT, YOU ARE AGREEINGTO BE BOUND BY
THE TERMS OF THIS LICENSEAGREEMENT. IF YOU DO NOT AGREE TO THE TERMS
AND CONDITIONS OF THIS AGREEMENT, DO NOTUSE, DOWNLOAD OR OTHERWISE
ACCESS THESOFTWARE OR SERVICES AND (I) PROMPTLYRETURN THE
SOFTWARE OR SERVICE TO KYOCERAOR DELETE IT; OR (II) IF YOU HAVE
PURCHASED THEKYOCERA DEVICE ON WHICH THE SOFTWARE ORSERVICE IS
PRE-INSTALLED, PROMPTLY RETURNTHE DEVICE AND THE ACCOMPANYING
SOFTWARE(INCLUDING DOCUMENTATION AND PACKAGING) TOKYOCERA OR THE
KYOCERA AUTHORIZEDDISTRIBUTOR FROM WHICH YOU PURCHASED THE
KYOCERA DEVICE.
License:SubjecttothetermsandconditionsofthisAgreementandanyothertermsthatmaybe
incorporatedbyreferenceorotherwisepresentedtoyoupriortoyouruseoftheSoftware,Kyocera
grantsyoualimited,non-exclusive,licensetouseKyoceraandthirdpartyproprietarysoftwareand
servicesfoundinyourKyoceradeviceand/orpackagedwithyour Kyoceradevice,includingany
updatestosuchmaterialbywhatevermeansprovided,andanyrelateddocumentation
(“Software”).YoumayusetheSoftwareonlyasexpresslyauthorizedbythisAgreement.
Limitations:ThisSoftwareislicensedforuseonlyonthesingleKyoceradeviceyouoriginally
purchased.YouacknowledgeandagreethatownershipoftheSoftwareandallotherrights
associatedwiththeSoftwarenotexpresslygrantedinthisAgreementareretainedbyKyoceraorits
suppliersorlicensors.Youarenotpermittedto,inanyway,distributetheSoftwareormakeit
availableoveranetworkforuseonmorethanthesingleKyoceradeviceforwhichitwasoriginally
supplied.TheSoftwaremaybecopiedonlyaspermittedbyapplicablelawandasnecessaryfor
backuppurposes.YoumaynotremoveanyproprietarynoticesorlabelsontheSoftwareorany
copiesthereof.Youmaynotinanyway,modify,reverseengineer,decompile,disassembleor
createderivativeworksbasedontheSoftware(excepttotheextentthatthisrestrictionisexpressly
prohibitedbylaw).Youagreethatyouwillnotattempttocircumvent,disableormodifyanysecurity
technologyassociatedwiththeSoftware.YoumayusetheSoftwareonlyinamannerthatcomplies
withallapplicablelawsinthejurisdictionsinwhichyouuseit,including,butnotlimitedto,applicable
restrictionsconcerningcopyrightandotherintellectualpropertyrightsand/ortheexportcontrol
regulations.
